These Terms and Conditions govern all pool installation, landscaping, and related services provided by Easy Pools Inc. (“the Contractor”) to the client (“the Owner”). By signing a contract with Easy Pools Inc., the Owner agrees to the terms set out below.
1. Scope of Work and Changes
All work will be carried out in accordance with the agreed specifications set out in the signed contract. Any deviation from those specifications — whether an addition, substitution, or omission — must be agreed upon in writing by both parties before the change is made. Payment for additional work and allowances for omitted work will be established in writing in advance, on demand by either party.
2. Insurance
The Contractor carries worker’s compensation insurance covering all its employees, and maintains adequate public liability and property damage insurance for all projects. Certificates of insurance are available on request.
3. Ownership of Materials
All materials supplied by the Contractor remain the property of the Contractor until full payment for the completed project has been received.
4. Termination or Abandonment by the Owner
If the Owner chooses to terminate the contract or abandon the project at any stage of its development, the Contractor is entitled to just and equitable compensation for all services performed and costs incurred up to the date of written notification. The initial deposit paid at contract signing is non-refundable in all circumstances, as it is applied to the costs of securing materials, equipment bookings, and scheduling.
5. Drawings and Specifications
All drawings, plans, and specifications prepared by the Contractor remain the property of the Contractor until the Owner’s account is paid in full.
6. Force Majeure
This agreement is contingent upon conditions beyond the Contractor’s reasonable control, including but not limited to: adverse weather, acts of God, product unavailability, labour disputes, supply chain disruptions, and accidents. The Contractor will notify the Owner of any such delay as soon as reasonably practicable and will resume work as soon as conditions permit.
7. Underground Services and Property Lines
The Contractor is responsible for arranging locates of all underground utilities and services (including cable, gas, telephone, hydro, water, irrigation, and lighting) through Ontario One Call before excavation begins, as required by Ontario law.
The Owner is responsible for the accurate identification and marking of all property lines. The Contractor will not be held responsible for claims or damages arising from the Owner’s failure to correctly locate property lines or any underground services not identified through the standard locate process.
8. Irrigation and Garden Lighting Systems
In any landscaping or pool installation project, some incidental damage to existing irrigation systems and/or garden lighting may occur despite reasonable precautions. The Contractor cannot be held responsible for such damage. On larger-scale projects, the Contractor recommends that existing irrigation and lighting systems be redesigned or reinstalled to accommodate the new layout.
9. Unforeseen Site Conditions
The Contractor shall not be responsible for damage to the property caused by unforeseen or unforeseeable circumstances, including vandalism or acts of God occurring during or after construction.
10. Obstructions Encountered During Excavation
The Owner shall bear the cost of removing any obstruction encountered during excavation that was not disclosed or reasonably discoverable prior to work commencing. This includes, but is not limited to, buried rocks, stumps, old foundations, and unmarked underground structures. The Contractor will notify the Owner in writing before proceeding with any additional work and associated costs.
11. Warranty
11.1 What is covered All hard landscaping and pool equipment installed by the Contractor is warranted against defects in workmanship for a period of three (3) years from the date of project completion.
The warranty covers one-time, free-of-charge repair and/or replacement of each defective item within the warranty period. Each item is covered once under this warranty.
11.2 What is not covered The following are not covered by this warranty:
- Plant materials, trees, and sod supplied by the Contractor
- Damage caused by vandalism or animals
- Damage caused by the use of de-icing salt (calcium chloride) on hardscapes — the use of alternative de-icing products is strongly recommended
- Damage caused by the Owner’s failure to maintain the landscaping or pool in accordance with standard care requirements during the warranty period
11.3 Conditions for warranty service
- The Owner’s account must be paid in full before any warranty work is performed
- Any outstanding balance overdue by more than ninety (90) days will void all warranties and guarantees
- Outstanding balances will accrue interest at a rate of 2% per month
12. Pool Enclosure Permit
The Contractor will prepare and submit the pool enclosure permit application on the Owner’s behalf. The cost of this submission is included in the project price. The Owner is responsible for ensuring property access for any required City inspections.
13. Payment Terms
Payments are due at the following project milestones:

| Contract signed | 10% of total contract value |
| Excavation complete and pool kit installed | 30% of total contract value |
| Main work complete (pool structure, backfill, coping, interlocking base) | 40% of total contract value |
| Final project completion | 20% of total contract value |
All payments are due upon reaching the relevant milestone. The Contractor reserves the right to pause work if a scheduled payment is not received within five (5) business days of the milestone being reached. Materials remain the property of the Contractor until all payments have been received in full.
14. Governing Law
These Terms and Conditions are governed by the laws of the Province of Ontario and the applicable laws of Canada. Any dispute arising from this agreement that cannot be resolved between the parties will be referred to the appropriate Ontario courts.
15. Amendments
These Terms and Conditions may be updated from time to time. The version in effect at the time a contract is signed governs that contract. The current version is published at easypools.ca/terms-and-conditions/.
